This Privacy Policy explains how GoodSleepCo USA LLC ("Good Sleep Co", "we", "us", "our") collects, uses, discloses, and protects your information when you visit goodsleepco.com, use the SleepCare app, purchase our products, or receive our services in the United States.

Our laboratory and returns facility is at 805 W Carrier Pkwy #240, Grand Prairie, TX 75050.

If you are located in Australia or New Zealand, our Australian Privacy Policy applies to you instead.

1.  Information we collect

 

Information you give us

   Identity and contact details — name, email, postal address, phone number.

   Date of birth, collected during registration for the Good Sleep Test to verify your identity and confirm eligibility.

   Order and payment information. We do not store full payment card numbers; credit card payments are processed securely by Stripe.

   Health information you provide, including responses to our sleep quiz, dental history, height and weight, symptoms, CPAP use, and information you share with our clinical team.

   Communications with us — email, SMS, chat, call recordings and transcriptions, and support enquiries.

Information generated through your use of our products and services

   Sleep test data recorded during the Good Sleep Test, including oxygen saturation, pulse and sleep metrics.

   Intraoral scan data and clinical assessments where you obtain a custom oral appliance.

   SleepCare app registration details, usage and treatment progress data.

Information collected automatically

   Device and browser data, IP address, operating system, and pages viewed.

   Cookies and similar technologies, including analytics and advertising tags. See section 8.

Information from third parties

   Your healthcare providers, including referring physicians, dentists and sleep consultants.

   Partner telehealth and referral organizations where you have engaged them.

   Advertising and analytics providers.

 

2.  Sensitive and health information

 

Some information we collect is sensitive. This includes health information, sleep test results, dental history and treatment records.

 

We collect and use this information to provide the products and services you have requested. Where required by law, we obtain your consent before collecting, using or disclosing it, and you may withdraw that consent at any time by contacting us.

 

We do not sell sensitive or health information, and we do not use it for targeted advertising.

 

3.  How we use your information

 

   To provide, ship and support the products and services you purchase.

   To facilitate clinical review, eligibility assessment and treatment through licensed providers.

   To communicate with you about your order, test results and treatment.

   To verify your identity when you contact us.

   To provide customer service and respond to enquiries.

   To send marketing communications where you have opted in, and to measure their effectiveness.

   To improve our products, services, website and app.

   To detect and prevent fraud and misuse.

   To comply with legal obligations, including FDA and state healthcare requirements.

 

We do not use your date of birth, health information or treatment status to target advertising to you.

 

4.  How we disclose your information

 

We disclose personal information to:

 

   Licensed dentists and clinical reviewers in our network, so they can assess your suitability and manage your treatment. These disclosures are made under Business Associate Agreements where HIPAA applies.

   Service providers performing functions for us — hosting, payment processing, shipping, laboratory manufacturing, customer relationship management, email and SMS delivery, and analytics. They are contractually restricted to using your information only for the services they perform for us.

   Referral partners where you have been referred to us, or where you ask us to coordinate your care.

   Legal and regulatory recipients where required by law, court order, or to protect rights and safety.

   A successor entity in a merger, acquisition or asset sale.

 

Some of our service providers and affiliated entities are located outside the United States, including in Australia. Where we transfer your information internationally, we take steps to ensure it remains protected in accordance with this policy and applicable law.

 

5.  Your privacy rights

 

Depending on where you live, you may have some or all of the following rights:

 

   Know and access — what personal information we hold about you, and obtain a copy.

   Delete — request deletion, subject to legal and clinical record-keeping obligations.

   Correct — request correction of inaccurate information.

   Opt out — of the sale or sharing of personal information, and of targeted advertising.

   Limit use of sensitive personal information.

   Non-discrimination — we will not deny service, charge different prices, or provide a lesser quality of service because you exercised a privacy right.

   Appeal — if we decline a request, you may appeal, and we will respond within the timeframe required by your state’s law.

State-specific rights

 

   California (CCPA/CPRA). You have the rights above, plus the right to know the categories of personal information collected, the purposes for which they are used, and the categories of third parties to whom they are disclosed. You may opt out of the sale or sharing of personal information using the "Do Not Sell or Share My Personal Information" link in our footer.

   Washington (My Health My Data Act). You have the right to confirm whether we collect, share, or sell your consumer health data, to withdraw consent, and to have that data deleted. We obtain separate consent before collecting consumer health data and before any sharing of it.

   Nevada. You may opt out of the sale of covered health information.

   Texas, Virginia, Colorado, Connecticut, Utah, Oregon, Montana and other states with comprehensive privacy laws: the rights above apply as provided by your state’s law.

 

6.  How we protect your information

 

   Encryption in transit and at rest for health information and clinical records.

   Role-based access controls — staff access only what their role requires. Clinical records are restricted to clinical personnel.

   Business Associate Agreements with vendors handling protected health information.

   Staff training on information security and confidentiality.

   Regular review of our security practices.

 

No system is completely secure. If a breach affecting your information occurs, we will notify you and the relevant regulators as required by law.

 

7.  How long we keep your information

 

   Order and transaction records: 5-10 years, to meet tax and warranty obligations.

   Clinical and treatment records: 5-10 years, in accordance with applicable state medical record retention requirements.

   Marketing contact data: until you opt out, after which we retain only what is needed to honor your opt-out.

   SMS consent records: retained for at least four years to evidence consent under the Telephone Consumer Protection Act.

 

8.  Cookies, analytics and advertising

 

We use cookies and similar technologies for site functionality, analytics and advertising. Our advertising partners may include Meta and Google.

 

   You can control cookies through your browser settings.

   We honor Global Privacy Control (GPC) signals as an opt-out of sale and sharing where your state recognizes them.

   We do not use health information, treatment status or date of birth for targeted advertising.

 

9.  SMS and mobile messaging

 

We send SMS only where you have given express written consent. Consent is never a condition of purchase.

 

   You may consent when completing a form on goodsleepco.com, during checkout, or when registering in the SleepCare app.

   Message frequency varies. Message and data rates may apply.

   Reply STOP to opt out at any time, or HELP for assistance.

   We do not send clinical results or health details by SMS. A message may tell you that results are available and invite you to log in or book a call.

Notwithstanding the above, mobile phone numbers and SMS consent will never be shared with third parties or affiliates for marketing purposes.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

 

10.  Protected Health Information and HIPAA

 

Where we handle Protected Health Information as defined by HIPAA, we do so in accordance with HIPAA and applicable state law. Your intraoral scans, clinical assessments, sleep test results, and treatment records constitute PHI.

 

We use encrypted systems and maintain Business Associate Agreements with our network of reviewing dentists and clinical service providers. Clinical records held by a treating provider are governed by that provider’s own notice of privacy practices.

 

11.  Third-party links

 

Our website and app link to third-party sites and services, including scheduling and provider platforms. We are not responsible for their privacy practices. Please review their policies before providing information.

 

12.  Children

 

Our products and services are intended for adults aged 18 and over. We do not knowingly collect personal information from children under 13. If we learn that we have, we will delete it.

13.  Changes to this policy

 

We may update this policy from time to time. Material changes will be posted here with a revised "Last updated" date, and where required we will notify you directly.
